Le visa d'investisseur E-2 permet à une personne d'être admise aux États-Unis lorsqu'elle investit un montant substantiel de capital dans une entreprise américaine. Le visa E-2 permet à l'investisseur de vivre et de travailler aux États-Unis pour diriger et développer l'entreprise. Certains employés d'une telle personne ou d'une organisation qualifiée peuvent également bénéficier de cette classification.

Qualification

Les personnes qui souhaitent investir leur argent aux États-Unis et créer leur propre entreprise avec un capital substantiel peuvent prétendre au visa E-2.

Vous pouvez prétendre à un visa E-2 si vous remplissez les conditions suivantes, telles que : 
  • Vous avez investi, ou êtes activement en train d'investir, une somme d'argent substantielle dans une entreprise authentique aux États-Unis;
  • Vous cherchez à entrer aux États-Unis uniquement pour développer et diriger l'entreprise dans laquelle vous investissez.
Il s'agit de la classification générale pour l'E-2 en tant qu'employé d'un commerçant ou d'un investisseur signataire du visa :
  •  Vous êtes de la même nationalité que le principal employeur étranger (qui doit avoir la nationalité du pays signataire du traité);
  • Vous répondez à la définition du terme "employé" en vertu de la législation applicable; 
  • Vous exercez des fonctions de direction ou de supervision ou, si vous êtes employé dans une moindre mesure, vous possédez des qualifications particulières.

In years past, spouses of certain E and L visa categories were required to apply for and receive an Employment Authorization Document in order to work in the United States. However, as the result of a settlement reached by USCIS in the class action lawsuit Shergill v. Mayorkas on November 10, 2021, USCIS now considers E and L dependent spouses to be authorized for employment incident to their status.
