O visto de imigrante EB-1C aplica-se a um executivo ou gerente multinacional
que tenha trabalhado no exterior por um ano nos últimos três anos em uma empresa estrangeira e que pretenda trabalhar nos EUA para uma empresa americana relacionada em cargo executivo ou de gerente.
O visto de executivo ou gerente multinacional EB-1C, é um visto de imigrante (caminho para residência permanente “green card”) para um executivo ou gerente multinacional.
Para se qualificar para um visto de imigrante EB-1C a empresa dos EUA deve comprovar:
1. O executivo ou gerente da multinacional deve ter trabalhado em empresa estrangeira por um ano completo dos últimos três anos
2. O executivo ou gerente multinacional deve procurar entrar nos Estados Unidos sob o status EB-1C com a finalidade de fornecer serviços em capacidade executiva
ou gerencial
- A capacidade executiva geralmente se refere à capacidade do funcionário de tomar decisões de ampla latitude sem muita supervisão.
- A capacidade gerencial geralmente se refere à capacidade do funcionário de supervisionar e controlar o trabalho de funcionários profissionais e de gerenciar a organização, ou um departamento, subdivisão, função ou componente da organização. Também pode se referir à capacidade do funcionário de gerenciar uma função essencial da organização em alto nível, sem supervisão direta de outros.
- Uma relação qualificada existe por exemplo quando as empresas são filiadas entre si, ou quando a empresa dos EUA é uma filial ou subsidiária da empresa estrangeira.
- A empresa dos EUA pode provar a relação de qualificação por meio de documentação de apoio, como: documentos de incorporação, estatutos, certificados de ações, artigos de organização, transferências bancárias, etc.
- A empresa dos EUA pode provar que está fazendo negócios por meio de documentação de apoio, como: documentos de incorporação, estatutos, certificados de ações, artigos de organização, extratos bancários, declarações de lucros/perdas, declarações fiscais, documentos de folha de pagamento, contrato de arrendamento, etc.
