Nuevo permiso para ucranianos

A partir del 27 de febrero de 2024, los ciudadanos ucranianos que están físicamente presentes en los Estados Unidos pueden solicitar un permiso para continuar permaneciendo en los Estados Unidos. Para solicitar el permiso la persona solicitante tiene que rellenar y presentar el Formulario I-131, Solicitud de Documento de Viaje, y pagar las tasas de presentación correspondientes a USCIS.
Para tener derecho al permiso la persona solicitante debe demostrar:
- Ciudadanía ucraniana
- Que obtuvo un permiso en los Estados Unidos después del 11 de febrero de 2022
- Estar físicamente presente en los Estados Unidos
- Razones humanitarias urgentes o beneficio público significativo para la emisión de un nuevo período de permiso
- Cumplir de las condiciones del permiso inicial
- Superar la revisión de antecedentes
- Garantizar un ejercicio favorable de la discreción
Si USCIS aprueba la solicitud del permiso, la persona solicitante puede presentar el Formulario I-765, Solicitud de Autorización de Empleo, categoría (c)(11) para recibir un permiso de trabajo y poder trabajar legalmente en los EE.UU. Es importante que la persona solicitante espere hasta que el Formulario I-131 sea aprobado para presentar el Formulario I-765, de lo contrario, si USCIS deniega la solicitud del permiso, las tasas de presentación del Formulario I-765 pueden no ser reembolsadas.
