O Ato de Violência Contra Mulheres, também conhecido como VAWA, permite que cônjuges, pais e filhos de cidadãos dos EUA e Residentes Permanentes Legais (LPRs) que foram submetidos a abusos solicitem uma reparação judicial imigratória. Uma pessoa também pode ser elegível para solicitar o VAWA se o seu cônjuge cidadão dos EUA ou LPR tiver submetido seu filho a agressão ou crueldade extrema.
Uma pessoa que é elegível para o VAWA pode "auto-peticionar" pelo reparo. Ao auto-peticionar, a pessoa pode solicitar por si mesma sem o conhecimento, consentimento ou participação do agressor no processo.
Aqui está um breve resumo dos requisitos de elegibilidade para o VAWA:
1. Ser submetido a agressão ou crueldade extrema por um cônjuge, pai/mãe ou filho cidadão dos EUA ou LPR. Agressão ou crueldade extrema pode ser abuso físico, atos violentos ou ameaças de violência, abuso sexual, abuso verbal e degradação, abuso emocional, isolamento, intimidação, abuso econômico, coerção ou ameaças de tirar os filhos ou chamar a imigração.
2. Residir ou ter residido com o cônjuge, pai/mãe ou filho abusivo cidadão dos EUA ou LPR.
3. Como cônjuge auto-peticionante de um cidadão dos EUA ou LPR abusivo, o auto-peticionante também deve demonstrar que entrou no casamento de boa-fé. O casamento ainda deve ser válido ou, se divorciado, o casamento deve ter terminado menos de dois anos antes da apresentação da petição VAWA.
4. O auto-peticionante deve demonstrar que é uma pessoa de bom caráter moral. Para determinar se uma pessoa tem bom caráter moral, a imigração examina o histórico criminal e imigratório do auto-peticionante ou a falta dele.
Observe que cônjuges ou filhos agredidos de cidadãos dos EUA ou LPRs, que estão em processos de remoção, também podem ser elegíveis para a reparação judicial do VAWA através do cancelamento de remoção.
