É uma petição que pode ser apresentada por um Residente Permanente Legal ou um Cônjuge Cidadão dos EUA
em nome do cônjuge imigrante para obter um green card. Para apresentar a petição, os indivíduos têm que ser legalmente casados, não é necessário período específico, mas a duração do casamento no momento da entrevista pode afetar se um green card de 2 ou 10 anos é emitido ou aprovado.
Há duas petições que devem ser preenchidas: a Petição I-130 para Parente Estrangeiro e a I-485 Requerente para Registro de Residência Permanente. Se o cônjuge imigrante estiver nos EUA, essas duas petições são apresentadas ao mesmo tempo. Dependendo do status do cônjuge imigrante no momento da solicitação, ele também poderá solicitar o I-765 Petição de Autorização Trabalho /Advance Parole.
Cada inscrição tem sua própria taxa que deve ser paga ao USCIS e requer documentação de apoio. Uma vez que as petições são arquivadas junto com os documentos necessários, incluindo documentação para mostrar que o casamento é um casamento de boa-fé ou real, e é recebido pelo USCIS, um recibo é emitido, seguido de um aviso de marcação de biometria para o cônjuge imigrante. Depois disso, o casal deve esperar que uma entrevista seja agendada para eles pelo USCIS.
