Em 26 de agosto de 2024, o Tribunal Distrital dos Estados Unidos para o Distrito Leste do Texas, no caso Texas v. Department of Homeland Security
(DHS), processo número 24-cv-306, emitiu uma suspensão administrativa que temporariamente impede o Departamento de Segurança Interna (DHS) de conceder "parole in place" (permissão de permanência) sob o programa Mantendo Famílias Unidas
por 14 dias.
Neste caso, o Estado do Texas, juntamente com outros demandantes, alegam que o DHS implementou políticas, que, segundo eles, violam as leis federais de imigração. Especificamente, eles argumentam que as diretrizes atuais do DHS para a fiscalização da imigração e procedimentos de deportação são muito brandas e não cumprem os requisitos legais. Os demandantes alegam que essas políticas enfraquecem a soberania estadual e contribuem para o aumento da imigração ilegal, o que, em sua opinião, tem impactos negativos na segurança pública e nos recursos do estado.
Durante esta suspensão de 14 dias, o USCIS (Serviços de Cidadania e Imigração dos EUA) não aprovará nenhuma solicitação de permissão de permanência pendente sob o programa Manter Famílias Unidas.
No entanto, o USCIS continuará aceitando solicitações de permissões de permanência para certos cônjuges e enteados de cidadãos dos EUA, e continuará a agendar consultas biométricas e capturar a biometria dos solicitantes.
Observe que a ordem de suspensão administrativa do tribunal distrital não afeta
